Every victim of a crime in Michigan is entitled to make a statement in open court regarding the impact of the crime on their life. The statement is limited to the victim’s physical, emotional and financial well being as it relates to the crime. Keep that in mind as you read my statement. Below is a copy of the victim impact statement I gave today at the Underwear Bomber sentencing hearing. When reading my statement, keep in mind that I am a practicing attorney in the State of Michigan. In addition, I regularly practice in the Court the hearings are taking place at and therefore, I am somewhat limited as to what I can say. We were limited to 5 minutes each.

I wish to thank the Court for allowing me these 5 minutes to make my statement. My references to the government in this statement refer to the Federal Government excluding this Court and the prosecution. On Christmas Day 2009, my wife and I were returning from an African safari and had a connecting flight through Amsterdam. As we waited for our flight, we sat on the floor next to the boarding gate. What I witnessed while sitting there and subsequent events have changed my life forever. While I sat there, I witnessed Umar dressed in jeans and a white t-shirt, being escorted around security by a man in a tan suit who spoke perfect American English and who aided Umar in boarding without a passport. The airline gate worker initially refused Umar boarding until the man in the tan suit intervened. The event meant nothing to me at the time. Little did I know that Umar would try to kill me a few hours later as our flight approached Detroit. The final 10 minutes of our flight after the attack were the worst minutes of my life. During those 10 minutes I sat paralyzed in fear. Unfortunately, what happened next has had an even greater impact on my life and has saddened me further.

When we landed, I was shocked that our plane taxied up to the gate. I was further shocked that we were forced to sit on the plane for 20 minutes with powder from the so called bomb all over the cabin. The officers that boarded the plane did nothing to ensure our safety and did not check for accomplices or other explosive devices. Several passengers trampled through parts of the bomb as they exited the plane. We were then taken into the terminal with our unchecked carry on bags. Again, there was no concern for our safety even though Umar told the officers that there was another bomb on board as he exited the plane. I wondered why nobody was concerned about our safety, accomplices or other bombs and the lack of concern worried me greatly. I immediately told the FBI my story in order to help catch the accomplice I had seen in Amsterdam. It soon became obvious that the FBI wasn’t interested in what I had to say, which upset me further. For one month the government refused to admit the existence of the man in the tan suit before changing course and admitting his existence in an ABC News article on January 22, 2010. That was the last time the government talked about this man. The video that would prove the truth of my account has never been released. I continue to be emotionally upset that the video has not been released. The Dutch police, meanwhile, in this article (show article), also confirmed that Umar did not show his passport in Amsterdam which also meant that he didn’t go through security as both are in the same line in Amsterdam. It upsets me that the government refuses to admit this fact.

An outraged father wrote this comment under my post: Thanksgiving: THANK YOU to all who participated in the National Opt Out Day. In getting the TSA to turn off its naked body scanners, we exposed the TSA’s “big lie” about air travel safety.

My daughter recently went through the airport security, traveling alone following her eighteen birthday. She was asked to step into the full body scanner, spread her legs and bend over. Then they took her carry-on, searched it by holding up her thong underwear one-by-one for public view. She was mortified, and I am now outraged at what we find “necessary” to security our civil liberties. …

And other officers, some with K-9s, sifted through the building,” reported the Daily Commercial.

The TSA continues to face not only opposition to its policies from travelers, but from credible critics as well. Dr. Edward Dauer, head of radiology at the Florida Medical Center, has come forward to warn that the controversial body scanners used at airport checkpoints can cause cancer, particularly affecting those over age 65, as well as women of all age who’ve been found with genetic predisposition to developing breast cancer.

NEW DEVICES: Agency says Tuck’s claims are inaccurate.

Alaska state Rep. Chris Tuck is running TV ads telling people they can skip the new body scanners at Alaska airports and should call airport police if the Transportation Security Administration gets too frisky with the resulting pat-downs.

But Tuck is wrong in making the claim that “inappropriate images are taken and stored” with the security scanners, according to the TSA.

“All we’re doing is creating security theater, giving Americans the belief that they are safer. But the real question is, ‘Are we safer?’ ” he said.

Anchorage travel analyst and TSA critic Scott McMurren applauded Tuck’s effort. McMurren said he believes TSA does store the images.

“They have to store them; how else would they go back and see them if there is an issue?” he said.

But McMurren said that the bigger point is that the body scanners are “invasive, degrading, ineffective and expensive.”

Obama finishes the job-- destroying the Bill of Rights completely.Today is December 15. 220 years ago, a coalition of founding fathers concerned about the over-centralization of power under the United States Constitution as written succeeded at last in adding a Bill of Rights that would protect individual freedoms and limit the reach of the federal government. Thus, ten critical amendments to the Constitution were ratified by the states and entered into law in 1791.

These guaranteed rights, including that of free speech, arms, privacy and due process– among others, have not only been violated by the modern State but trampled upon and trashed through arrogant and unconstitutional legislation, executive orders & statements and a lack of common sense protection in the courts.

The Senate has now passed the reconciled version of the NDAA, earlier passed by the House, putting into law for the first time the asserted “right” of government to indefinitely detain American citizens without trial. Nothing could be more un-American or against the Bill of Rights. The President, reversing his previous ‘threat’ to veto the bill, is now expected to sign the bill. RT appropriately writes:

Exactly 220 years to the date after the Bill of Rights was ratified, the US Senate today voted 86 to 13 in favor of the National Defense Authorization Act for Fiscal Year 2012, allowing the indefinite detention and torture of Americans.

Paul Joseph Watson has already written on how the ACLU and Human Rights Watch organization blasted Obama for his “u-turn” on the vetoing the NDAA bill which contains the provision allowing the indefinite detention of American citizens. He notes that: HRW describes Obama’s about-face as a “historic tragedy for rights”. Indeed. HRW’s executive director Kenneth Roth further stated:

“By signing this defense spending bill, President Obama will go down in history as the president who enshrined indefinite detention without trial in US law… In the past, Obama has lauded the importance of being on the right side of history, but today he is definitely on the wrong side.”

But more significantly, Paul Joseph Watson highlights the fact that the Obama Administration was never concerned with rights in the consideration of this bill. He writes, “Obama’s veto threat was never about stopping detention without trial of American citizens, it was about ensuring that the federal government didn’t completely hand such powers over to the U.S. military, and enshrining into law Obama’s unconstitutional policy of targeting Americans as terrorists without the legal requirement to offer any proof.”

Like other presidents who’ve moved the football of executive overreach down the field, President Obama and his administration advisors wanted to maintain the appearance of the president’s prerogative to selectively detain Americans without trial. What George W. Bush controversially did to accused and/or potential terrorists via the War on Terror by denying them any pretense of due process, Obama has now brought to the homeland.

Top tier presidential candidate Ron Paul has decried the ‘indefinite detention’ provision of the National Defense Authorization Act, warning that it represents an arrogant, bold and dangerous attempt to establish martial law in America.

Speaking with the Alex Jones Show today, Congressman Paul went on the offensive against the bill, which is set to be signed into law by President Obama later this week.

Section 1031 of the NDAA bill, which itself defines the entirety of the United States as a “battlefield,” allows American citizens to be snatched from the streets, carted off to a foreign detention camp and held indefinitely without trial. The bill states that “any person who has committed a belligerent act” faces indefinite detention, but no trial or evidence has to be presented, the White House merely needs to make the accusation.

Paul said he saw significance in “the announcement and the arrogance of it all,” making reference to the Obama administration’s claim that it can now assassinate American citizens anywhere in the world and noting that the passage of the NDAA bill is an effort to codify the policy into law.

“This is a giant step — this should be the biggest news going right now — literally legalizing martial law,” said Paul, noting that the subject did not come up at all in any of the Republican debates.

The Congressman also decried the “arrogance” of an attempt to push through via a voice vote an amendment that would have still authorized indefinite detention even if a detainee was found innocent after a trial. The amendment was narrowly defeated by his son, Senator Rand Paul.

“This is big,” emphasized Paul, adding “This step where they can literally arrest American citizens and put them away without trial….is arrogant and bold and dangerous.”

Despite speculation that the Obama administration would veto the bill, it emerged yesterday that it was the White House itself which worked to remove language from the bill that would have protected American citizens from indefinite detention under Section 1031.

The administration has been working with lawmakers to alter a separate provision, Section 1032, which pertains to the military being required to take custody of individuals.

With the administration’s concerns over Section 1032 now largely resolved, a revised and final version of the bill could be signed into law before the end of the week.

“The conferees said they plan to bring the bill to the House floor for a vote as soon as Wednesday afternoon and to the Senate soon thereafter,” reports Politico.

Despite the revisions, the bill still contains language that allows Americans to be detained without trial at a detention center anywhere in the world.

Republican Congressman Justin Amash has again warned that lawmakers are attempting to mislead the American people by claiming U.S. citizens are exempt from the most dangerous provisions of the bill.

“Pres. Obama and many Members of Congress believe the President ALREADY has the authority the bill grants him. Legally, of course, he does not. This language was inserted to keep proponents and opponents of the bill appeased, while permitting the President to assert that the improper power he has claimed all along is now in statute,” writes Amash.

“They will say that American citizens are specifically exempted under the following language in Sec. 1032: “The requirement to detain a person in military custody under this section does not extend to citizens of the United States. Don’t be fooled. All this says is that the President is not REQUIRED to indefinitely detain American citizens without charge or trial. It still PERMITS him to do so,” warns the Congressman.

Amash is encouraging Americans to contact their representatives and sign a petition expressing their opposition to the NDAA bill, calling it “one of the most anti-liberty pieces of legislation of our lifetime.”
